在船舶滅失或沉沒時(shí)的失業(yè)賠償公約 國(guó)際勞工組織全體大會(huì), 經(jīng)國(guó)際勞工局理事會(huì)召集于1920年6月15日在熱那亞舉行會(huì)議, 經(jīng)議決采納本屆大會(huì)熱那亞會(huì)議議程第二項(xiàng)所列關(guān)于監(jiān)督協(xié)議條款的實(shí)施、設(shè)置海員職業(yè)介紹所和上年11月在華盛頓通過(guò)的失業(yè)和失業(yè)保險(xiǎn)公約和建議書適用于海員的若干提議, 經(jīng)決定這些提議應(yīng)采取國(guó)際公約的方式,通過(guò)下述公約,供國(guó)際勞工組織會(huì)員國(guó)依據(jù)國(guó)際勞工組織章程的規(guī)定加以批準(zhǔn),此公約得稱為《1920年失業(yè)補(bǔ)償(沉船)公約》。 第1條 ?。保捅竟s而言,“海員”一詞包括在海上航行的任何船上受雇的一切人員。 ?。玻捅竟s而言,“船舶”一詞包括在海上航行的、無(wú)論其性質(zhì)如何、公有或私有的所有船舶和小艇,但軍艦除外。 第2條 ?。保慨?dāng)任何船舶滅失或沉沒時(shí),船東或與海員簽訂船上服務(wù)合同的人應(yīng)向每個(gè)受雇的海員支付由這種滅失或沉沒所產(chǎn)生的失業(yè)賠償。 2.在海員實(shí)屬失業(yè)期間,應(yīng)按合同規(guī)定以同樣工資比率支付這筆賠償費(fèi),但按本公約向任何一個(gè)海員支付的賠償總額僅限于兩個(gè)月的工資。 第3條 像獲得其工作期間所得工資的欠款一樣,海員應(yīng)獲得此種賠償?shù)娜拷痤~。 第4條 1.批準(zhǔn)本公約的國(guó)際勞工組織各會(huì)員國(guó)保證將本公約應(yīng)用于它的那些不能完全自治的殖民地、保護(hù)領(lǐng)地和屬地: ?。ǎ幔┑捎诋?dāng)?shù)貤l件本公約條款不適用者除外; ?。ǎ猓┛蓪?duì)公約作必要的修改,以使公約條款適應(yīng)當(dāng)?shù)貤l件。 ?。玻鲿?huì)員國(guó)應(yīng)將其對(duì)每個(gè)不能完全自治的殖民地、保護(hù)領(lǐng)地和屬地所采取的行動(dòng)通知國(guó)際勞工局。 第5條 本公約的正式批準(zhǔn)書,按照國(guó)際勞工組織章程規(guī)定的條件,應(yīng)送請(qǐng)國(guó)際勞工局局長(zhǎng)登記。 第6條 國(guó)際勞工組織兩個(gè)會(huì)員國(guó)的批準(zhǔn)書一旦被國(guó)際勞工局登記,國(guó)際勞工局局長(zhǎng)應(yīng)立即將此通知本組織所有會(huì)員國(guó)。 第7條 本公約應(yīng)自國(guó)際勞工局局長(zhǎng)發(fā)布這種通知之日起生效并僅對(duì)其批準(zhǔn)書已經(jīng)國(guó)際勞工局登記的會(huì)員國(guó)具有約束力。此后,對(duì)于任何會(huì)員國(guó),本公約將自其批準(zhǔn)書經(jīng)國(guó)際勞工局登記之日起生效。 第8條 依照第7條規(guī)定,批準(zhǔn)本公約的各會(huì)員國(guó)同意于1922年7月1日之前實(shí)施本公約規(guī)定,并采取實(shí)施這些規(guī)定所必要的行動(dòng)。 第9條 凡批準(zhǔn)本公約的會(huì)員國(guó),自本公約初次生效之日起滿5年后,可以向國(guó)際勞工局局長(zhǎng)通知解約,并請(qǐng)其登記。此項(xiàng)解約通知書自經(jīng)國(guó)際勞工局登記之日起滿1年后始得生效。 第10條 國(guó)際勞工局理事會(huì)在其認(rèn)為必要時(shí),應(yīng)將本公約的實(shí)施情況向大會(huì)提出報(bào)告,并審查是否將本公約的全部或局部修正問題列入大會(huì)議程。 第11條 本公約的法文本與英文本同等為準(zhǔn)。 【名稱】 CONVENTION No.8 Convention concerning Unemployment Indemnity inCase of Loss or Foundering of the Ship 【題注】 [Date of coming into force: 16 March 1923.] Whole document The General Conference of the International Labour Organization, Having been convened at Genoa by the Governing Body of the International Labour Office, on the 15th day of June 1920, and Having decided upon the adoption of certain proposals with regard to the supervision of articles of agreement; provision of facilities for finding employment for seamen; application to seamen of the Convention and Recommendations adopted at Washington in November last in regard to unemployment and unemployment insurance, which is the second item in the agenda for the Genoa meeting of the Conference, and Having determined that these proposals shall take the bbbb of an international Convention, adopts the following Convention, which may be cited as the Unemployment Indemnity (Shipwreck) Convention, 1920, for ratification by the Members of the International Labour Organization in accordance with the provisions of the Constitution of the International Labour Organization: Article 1 1. For the purpose of this Convention, the term "seamen" includes all persons employed on any vessel engaged in maritime navigation. 2. For the purpose of this Convention, the term "vessel" includes all ships and boats, of any nature whatsoever, engaged in maritime navigation, whether publicly or privabbby owned; it excludes ships of war. Article 2 1. In every case of loss or foundering of any vessel, the owner or person with whom the seaman has contracted for service on board the vessel shall pay to each seaman employed thereon an indemnity against unemployment resulting from such loss or foundering. 2. This indemnity shall be paid for the days during which the seaman remains in fact unemployed at the same rate as the wages payable under the contract, but the total indemnity payable under this Convention to any one seaman may be limited to two months wages. Article 3 Seamen shall have the same remedies for recovering such indemnities as they have for recovering arrears of wages earned during the service. Article 4 1. Each Member of the International Labour Organization which ratifies this Convention engages to apply it to its bbbbbies, protectorates and possessions which are not fully self-governing-- (a) except where owing to the local conditions its provisions are inapplicable; or (b) subject to such modifications as may be necessary to adapt its provisions to local conditions. 2. Each Member shall notify to the International Labour Office the bbbbbb taken in respect of each of its bbbbbies, protectorates and possessions which are not fully self-governing. Article 5 The bbbbal ratifications of this Convention, under the conditions set forth in the Constitution of the International Labour Organization, shall be communicated to the Director-General of the International Labour Office for registration. Article 6 As soon as the ratifications of two Members of the International Labour Organization have been registered with the International Labour Office, the Director-General of the International Labour Office shall so notify all the Members of the International Labour Organization. Article 7 This Convention shall come into force at the date on which such notification is issued by the Director-General of the International Labour Office, and it shall then be binding only upon those Members which have registered their ratifications with the International Labour Office. Thereafter this Convention will come into force for any other Member at the date on which its ratification is registered with the International Labour Office. Article 8 Subject to the provisions of Article 7, each Member which ratifies this Convention agrees to bring its provisions into operation not later than 1 July 1922, and to take such bbbbbb as may be necessary to make these provisions effective. Article 9 A Member which has ratified this Convention may denounce it after the expiration of five years from the date on which the Convention first comes into force, by an act communicated to the Director-General of the International Labour Office for registration. Such denunciation shall not take effect until one year after the date on which it is registered with the International Labour Office. Article 10 At such times as it may consider necessary the Governing Body of the International Labour Office shall present to the General Conference a report on the working of this Convention and shall examine the desirability of placing on the agenda of the Conference the question of its revision in whole or in part. Article 11 The French and English texts of this Convention shall both be authentic. |
